The FMCSA Drug and Alcohol Clearinghouse is an online database of drug and alcohol program violations by CDL drivers. It lets employers see whether a driver has a violation on record and whether they have completed the return-to-duty process. For carriers, the core obligation is simple: run the right queries at the right time and keep proof.
The rules are in 49 CFR Part 382, Subpart G.
Who the Clearinghouse covers
The Clearinghouse applies to employers of drivers who operate CMVs requiring a CDL and are subject to DOT drug and alcohol testing under Part 382. It covers drivers of both property and passenger vehicles, interstate and intrastate.
To use it, employers must register in the Clearinghouse and buy a query plan. Queries are made online. Many carriers designate a consortium or third-party administrator (C/TPA) to help. Owner-operators who employ themselves must designate a C/TPA to report violations on their behalf. They can still run their own queries.
Pre-employment queries
Under 49 CFR 382.701(a), before a driver performs any safety-sensitive function for you for the first time, you must conduct a full query.
Key points:
- A full query requires the driver’s electronic consent, given inside the Clearinghouse. The driver needs their own Clearinghouse account to do this.
- If the full query shows a driver is in prohibited status, the driver may not perform safety-sensitive functions for you.
- The pre-employment query is in addition to the pre-employment drug test, not a replacement.
Plan for delays. If the driver has never registered, they need to create an account before they can consent. Build this into your hiring checklist so it does not hold up a start date.
Annual queries
Under 49 CFR 382.701(b), you must query the Clearinghouse at least once every 12 months for each driver you employ.
For the annual query, you can use a limited query:
- A limited query tells you whether information about the driver exists. It does not release details.
- It requires the driver’s general written consent, which you obtain outside the Clearinghouse. The consent can cover more than one year if it says so.
- If the limited query shows information exists, you must run a full query within 24 hours, with the driver’s electronic consent.
- If you do not complete the full query within 24 hours, the driver may not continue performing safety-sensitive functions until you do and the results allow it.
Track each driver’s annual query date. Missing one is an easy audit finding. With drivers hired at different times, annual due dates spread across the calendar, so a single list of every driver’s last query date is worth keeping. Some carriers simply run all annual queries in the same month each year to keep things simple.
Recordkeeping
Employers must keep a record of each query and all information received from it for three years. Keep:
- Consent forms for limited queries.
- Query results or records of each query.
- Records showing any follow-up full queries.
The Clearinghouse keeps its own query history, but your records should show compliance without having to log in during an audit.
Your reporting duties
Queries are only part of it. Employers must also report certain information to the Clearinghouse under 49 CFR 382.705, such as:
- Refusals to test that the employer determines. Refusals determined by the MRO are reported by the MRO.
- Actual knowledge violations, such as observed use.
- Negative return-to-duty test results.
- Completion of follow-up testing.
MROs report verified positive drug results. Report on time. The deadlines are short.
Also note that states now use Clearinghouse information in CDL licensing decisions, and drivers in prohibited status can lose their commercial driving privilege. Check FMCSA for the current details on how that works.
Clearinghouse checklist
For a new driver:
- Confirm the driver has a Clearinghouse account.
- Request and receive electronic consent.
- Run the full query before any safety-sensitive work.
- File the result with your drug and alcohol records.
For every current driver, each year:
- Get or confirm general written consent.
- Run the limited query before the 12-month mark.
- If information exists, run a full query within 24 hours.
- File the result and set the next due date.
DOT Compliance Watch does not run Clearinghouse queries itself. It tracks your drug and alcohol program records and reminds you when each driver’s annual query is due, so nothing slips. For specific reporting questions, check FMCSA’s Clearinghouse resources or ask your C/TPA. You can find more in our resources section.
Keep queries on schedule
The Clearinghouse works when every query happens on time and every record is filed. That is a tracking problem, and tracking is the easy part to fix. Start your free 14-day trial and never lose track of a query date again.
